Federal law
Several states have passed laws governing online gambling, including skill games, sweepstakes, and online poker. Whether these laws are legal or not, however, is not certain.
While states have taken a lead on Internet gambling, the federal government remains hostile to its advancement. The Department of Justice has indicted three of the largest online poker sites. The Unlawful Internet Gaming Enforcement Act (UIGEA) prohibits the acceptance of money for illegal online gambling.
There are also other laws that pertain to online gambling. In addition to UIGEA, the Federal Wire Act prohibits the conduct of interstate betting on sporting events. While the Wire Act does not apply to casino gambling, it does apply to wagering businesses. A wagering business may be fined or imprisoned for a violation of the act.
Another federal law is the Indian Gaming Regulatory Act, which governs gambling activity on Indian reservations. Florida banned gaming promotions in cause-related marketing campaigns. The law has not been enforced because it conflicts with the dormant Commerce Clause doctrine.
Legality of online gambling in the U.S.
During the late 1990’s, the Internet gained popularity and online gambling emerged as a new form of gambling. Hundreds of online gambling sites were created. In 1998, the Frost & Sullivan report estimated that online gambling revenues had reached $830 million.
The United States government attempted to enforce a law prohibiting the operation of online gambling businesses in the United States. The Unlawful Internet Gaming Enforcement Act, or UIGEA, was enacted by Congress. The law makes it illegal for financial institutions to process transactions with unlicensed gambling websites.
The law was challenged in court by the Fifth Circuit, who disagreed with the Department of Justice’s interpretation of the Wire Act. The Justice Department argued that the Act should apply to all forms of Internet gambling.
In April 2007, Congress introduced a bill, HR 2046, that would regulate, license and enforce the laws on online gambling. The bill would require Internet gambling facilities to be licensed by the director of the Financial Crimes Enforcement Network. It would also modify the UIGEA.
Legality of online gambling in other countries
Various forms of online gambling are legal in many countries. However, the legality of a particular form of gambling varies from country to country. Some countries have strict rules on gambling while others have no laws at all. In some cases, gambling sites may be licensed and regulated by the government.
One of the first countries to legalize Internet gambling was India. Several other nations in the Caribbean Sea also permit online wagering. For example, the United Kingdom has an authorised gambling authority tasked with overseeing the licensing and regulation of Internet gambling. Various states in the US have their own online gambling regulatory authorities.
In terms of a legal online poker game, there are several major players in the industry. Amongst them, the Isle of Man and Gibraltar have a reputation for having the best casinos and poker rooms, with the most up-to-date licenses. Other jurisdictions such as Canada, Ireland, and the Bahamas also offer the Internet as a means of attracting tourists and locals to their shores.
